Ajanta Pharma, Inc. (APX) has filed a lawsuit against the federal government and the Philippines Food and Drug Administration (FDA) seeking to recover damages for the cost of the erectile dysfunction drug sildenafil, which is a PDE-5 inhibitor.
In its complaint filed in a federal court in the Philippines, the company claimed that it failed to disclose the facts on its website that it sold erectile dysfunction drugs, which are prescription drugs, to the FDA and was a “legitimized” drug.
In response, the company stated that it had not received a written response from the FDA, and that it would seek the agency’s permission to issue a patent if the FDA refused. The FDA has denied a similar suit filed by the Philippine International Trading Co., which is accused of selling Viagra, Sildenafil, and other PDE-5 drugs without the agency’s approval.
A previous suit filed in the Philippines by the state of Togo, the nation of the Philippines, alleged that the company failed to warn doctors of the dangers of taking sildenafil. However, the company has since stopped further litigation, and the lawsuit is expected to be filed soon.
According to the suit, the FDA’s decision to allow the use of sildenafil was based on the “concerns and concerns” that it raised in a letter to the FDA dated January 22, 2010.
The suit further alleges that the agency had no reason to believe that sildenafil was a PDE-5 inhibitor at the time it was sold.
According to the lawsuit, the FDA’s adverse judgment was based on information provided to the agency, including “data from a study conducted by Pfizer, Inc.” and “data obtained from the FDA’s own studies”, and “data obtained from the FDA’s own study,” which showed a “high safety” and “no side effects” with sildenafil.
The agency also told the consumer association that “the safety data was provided in a paper that was not disclosed.”
In addition, the suit states that sildenafil “has been prescribed for erectile dysfunction.”
The company has previously stated that it “has not received a written response from the FDA.”
A spokesperson for the company said that it has “removed the complaint to the Supreme Court of the Philippines” and that the company has yet to file a further response.
In addition to the lawsuit, the company is seeking compensation for losses it has suffered as a result of the alleged actions and allegations.
